Advice needed please PCN from Smart Parking ltd

Apologies for starting a new thread but I'm confused and in need of advice please. I have read through the Newbies thread and it suggests to use the appeal template in blue print. As the keeper of the vehicle I have received PCN from Smart Parking ltd. There are 2 pictures of the vehicle one entering and one leaving. There is a time lapse of 1hour 16mins between the two pictures. The intended stay was for the 1hour free parking. The date of the supposed contravention is 21.02.18 and the letter is dated 12.03.18 which was received on 14.03.18. Is the appeal letter in the blue print appropriate in this case? I have seen lots of posts about Smart Parking ltd at Fistral Beach but most are about errors with the machine which is not the issue here. Any advice would be appreciated. Thanks in advance.

    Yes, it is that simple and so are Smart Parking! One of the easiest firms to beat, who will probably give up as soon as they see the template (well, after dragging their heels for a month).

    What you are missing is, that by using this forum template, you are giving Smart Parking a clear message: that you will beat them because you are on MSE and you know they can't hold you liable as keeper, so they are stuffed.

    This is a message they tend to heed, although they take about a month to reply and cancel!

    PPCs recognise the forum appeal. Use it. As long as you are the registered keeper of course.

    You do not need to add anything nor mention the dates of the NTK, makes no odds because it's a non-POFA NTK anyway, regardless of dates.

    This is an entirely unregulated industry which is scamming the public with inflated claims for alleged breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose, and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.
  • This may sound silly but I am not local to Newquay (it was a vacation) so I presume the complaint would need to be made to the local MP there?

    Both! Search the forum for Steve Double. He will do what he can and might liaise with your MP.
