    As for the accountant (friend), the value of the stolen items was under £100, but it was felt by the magistrates court that given the circumstances of the accused and his status in society that the case should be remitted to Crown Court on request for sentencing.

    Where a case can be dealt with either by Magistrates or at the Crown Court, I thought the defendant had the right to a trial by jury?

    Yes they do, but no-one in their right mind would select a crown court when pleading guilty.

    The plea could have been not guilty at the Magistrates but changed to guilty at crown court after full disclosure?

    Quite right that is what I thought would have happened but it was said by the Judge that because of his intelligence and position in society he would go to prison as an example to others.

    I don't know anything about the law, I can only but give these two cases as an example of what does and can happen.

    The solicitor will have had the file before then in all likelihood. But yes I suppose that's a possibility.


    By the time it's at the crown court you may as well give trial a go though, the discount is 1/10th, so hardly any difference
