Hi all,

I have read through the Newbies thread, however feel confused on the route I need to take. Have just checked through some CEL posts but I think they are at a stage ahead of me.

Details of my claim:

Incident: 07/08/2017
PCN: 14/08/2017
Final Reminder Before Action: 15/09/2017
Letter Before Action: 17/10/2017
ZZPS 1st Letter: 14/11/2017
ZZPS 2nd Letter: 28/11/2017
QDR Solicitors Letter: 22/01/2017
CEL Letter (30 days to reply or issuing court proceedings): 08/03/2018

Could someone please advise process I need to take from here, from my understanding I can appeal based on no NTK given and being issued with PCN straight away.

If someone can point me in direction of another post or can message me to help out I'd greatly appreciate that. Or if someone has an example draft for an appeal that would be great.

    You are way beyond any appeal.

    You now need to respond to the LBC you have received from CEL.

    There are sample robust responses in post #2 of the NEWBIES FAQ sticky thread.

    Or you could use the forum search facility for CEL LBC response to see how others have managed.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors..

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.

    We don't need to, you can point yourself there. This is how to use the forum best.

    Search 'CEL defence' to read cases that take you right through from LBCCC to claim, then to CEL discontinuing. Your response for now simply needs to set out why the keeper isn't liable, and to ask for all photos and evidence and letters that they intend to rely upon. Same as lots of examples you will see, except that CEL are not sort of complying with the 30 days & enclosing a reply form.

    You actually want the claim because it's all downhill from there. Discontinued by the Summer, all over.
