HETAS certificate/ building regs

Hi All,
In the middle of the homebuying process. The log burner in the house does not have a HETAS (registered) have checked with HETAS.
The installation looks like it was in an existing chimney breast etc.
Without the HETAS, will it need building control sign off? I am a bit worried as per the chimney sweep reports the tube/liner has been installed the wrong way up, so may of been a cowboy job.
Where would I stand in the sales process in terms of getting the seller to rectify the issues of it’s not conforming to regs etc

* throw money at re-installing the burner and upgrading the chimney or
* offer you an 'indemnity policy' to protect you from the non-existant threat of the council enforcing Building Regs, or
* tell you he's been happily using the burner for years, it comes with the house, and is included in the sale, as is, at no extra charge0 -

I’m hoping it’s one of the first two. I know the survey has indicated some potential damp issues as a result of the poor work so hopefully he will see that and be reasonable0 -
When was the stove installed?
If before April 2005 then a HETAS certificate isn't required.0 -

Solicitor has come back and stated the fire has been there over 25 years. I am guessing there is nothing building regs can do etc?0

Unlikely Building Cert required due to time that has elapsed. Suggest that if you intend proceeding with the purchase, you get your own HETAS qualified person to inspect and make good any issues with the stove installation. While it has been there a long time, you don't know how often it has been used, or how it has been used, and there could be issues with fire risk / carbon monoxide fumes etc etc. Best of luck.0
