Help needed for pcn from cel

Hello,
I have never posts before and for months now before November I have been reading all the NEWBIES thread along with searching other people's experiences with civil enforcement ltd.

I am after some advice on how to go about my situation. Reading the faq really has helped but I am not clear where to start or where I stand as the cel use very scary words in the letter have received.

Long story short back in November 2017 I parked within a car park ran by cel and was caught on a parking eye entering and leaving the car park.
The maximum stay here is 4 1/2 hours. I ended up over staying by 18mins.
I was breast feeding my newborn baby once I returned to my car.
Before hand I took my 93 year old disabled nan to get food. I have to physically lift her in and out of the car.

I soon received a letter demanding £60 or £100 thereafter if I did not respond.
Foolishly I contacted the company and disagreed with the charge. I wrote in my appeal or my circumstances and they declined my appeal.
I then wrote it popla appealed and lost.
I had no idea how to complete the appeals and fen I left a lot of important words outs.

Today I have received a letter to say if I do not respond and now pay £140 (£100 for original charge + add cost) I will either have my vehicle seized, bailiffs or a ccj.
I am a bag of nerves and with reading other threads along with the newbies forum I just can not make heads of tails of where I stand now.
What do I do? I know on the f&q with first debt letter it says do nothing. Is this the answer to my own question?
Please help me.

    Their threat is empty in as much as they cannot seize your car/send bailiffs until they win a ccj against you which you don't pay off within a month of the judgement date


    If and when they send a lbcca or you get court correspondence then come back to the newbies faq thread for advice on how to deal with it


    Till then you can ignore the threats!

    - Ignore debt letters.

    - Wait for CEL to send a court claim, then copy what everyone else does and win.

    - Read some CEL defence threads, you will see a pattern, it is EASY and they discontinue.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors..

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.
    You never know how far you can go until you go too far.
  • Hello, so after all this time I have now received a county court claim.
    I have looked at so many defence claims and find it extremely over whelming.
    I am not sure where to start because as my first post I actually fought this and lost with popla.
    So when the first part of the defence states I have no idea what this is for I can't say that.
    I actually no longer own the car and from a newbie defence thread I have read I see I can state that I no longer own the car. Is this correct?
    Sorry to bother you it's just very hard to get my head around how to put this defence in.
    A lot of defence letters have stated dates. I am not sure on dates such as when letters were sent. At the time I never kept it all. (Another ridiculous move by me)
    Can you help me please?

    whilst you can add whatever you like about no longer owning the vehicle, its not relevant to your defence because you were the keeper at the time of the incident


    what is the DATE OF ISSUE on the claim form ?


    and repeat the full POC from that claim form in your reply too


    then read the NEWBIES FAQ sticky thread , post #2 , then read some of the recent defences on here, some are included in that thread, especially read the BARGEPOLE honed defences that are from this year only


    then ensure that you have logged into MCOL and done the AOS only, there are pictorial walkthroughs for that part linked in that same post #2



    then copy and paste a recent defence, plus edit and adapt it, then post it below for critique because you will be submitting it by email in a few weeks time

    What date was the claim issued?

    What EXACT WORDS (minus the VRN) are in the Particulars of Claim on the left?

  • Hello, I have had trouble accessing my thread.
    I received a small claims court form back in November for this fine still. I completing all parts due to advise on newbies thread. I copied and adapted the defence and sent my form off. I now have a letter confirming a small claims court date of the 10th April. They have asked me to send them any documents or evidence by March. I have no evidence or papers to send though?
    Any thoughts on what to do? Do I just contact civil enforcement to pay?

    Why, it is a scam. Read this and decide


    It is the will of Parliament that these scammers, (very often former clampers), be put out of business.

    Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    If you have filed your defence and the court has allocated you to a specific court, presumably you have filled in a DQ form. What the court should now be asking for is your Witness Statement and evidence which backs up the DEFENCE ALREADY SUBMITTED. Do not think of paying after you've gone this far. Here is the process explained in detail by a respected poster. Read and learn.
