Parking Fine - NCP - Sheffield

Hi All,
I've been the keeper of a car for about 8 years but in the space of two weeks the driver has been caught by parking fines for nearly identical issues. (The driver has never had a parking fine before)
I read the FAQ here, but i've already sent an appeal to both of these, so not sure if the driver can do the delay tactic that the guide walks you through
The driver parked in Doncaster & when they went to pay the machine was clearly covered, so the driver assumed, as there were cars around without tickets, the parking spaces were up for grabs. the driver came back to a parking ticket, took a picture of the broken machine & sent it to them, this was about a month ago & they have yet to receive a response.

The other however, was a week later in Sheffield, the driver went to pay, but again the machine was broken. That said, there were signs that stated it was 'pay by phone only' however in the drivers last experience of pay by phone you would still need a machine to print out a ticket. (This was in newcastle) so they stupidly assumed this was the same & could park there. Of course the driver came back to a ticket. They once again took a pic of the machine & went through the online appeal procedure.

If that ticket ref is genuine, then you need to edit it out ASAP..!

these are not PARKING FINES so you still have an unblemished record !!
they are Parking Charge Notices, or INVOICES , nothing more
no private company can "fine" you , or me , or the Queen for that matter
remove all identifying details from post #1
remove the VRM and any pcn ref numbers etc
and what happened on the day in question (or days) happened to the driver
what happened since those days happened to the KEEPER
only use the terms DRIVER and KEEPER in your posts and nobody should be admitting to being at fault either
it is for the PPC to prove their case, not for the unwitting keeper to make it for them0 -
You really do need to remove all the personal info from the original post . . . but also, I'd recommend quoting Cargius vs Parking Eye - it went to court but Mr Cargius won because the judge said that all that PE had lost was the amount that should have been paid for a parking spot. (Google it, it's an interesting case.) Yours is a similar case and the company is trying to issue a penalty, which is illegal and they can't do it. All they can claim back is any parking charge you didn't pay for the space you used but they won't even get that now. DO NOT pay! Challenge. This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors..
Parking Eye, CPM, Smart, and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.You never know how far you can go until you go too far.0 -

Now you might lose at POPLA as you probably blabbed about who the driver was, in your appeals. Don't make that mistake ever again, this was easily winnable at POPLA - and now, less so!
Give it a go, read the NEWBIES thread post #3 (about POPLA appeals) and construct a POPLA appeal. Do not write about the machine not working or the story of what happened. See the NEWBIES thread.
Bottom line, it is ONLY NCP, not a single person here pays their fake fines. If you ask us how likely it is for them to try court, we will know you haven't done the BMPA Insight search described in the linked thread.

I have read it, the court numbers are negligible & close to 0. Does this mean if i literally ignore the PCN from here on they'll just give up the ghost? or would it be better to progress to a POPLA appeal anyway?
So I would expect you to be more likely to be taken to court.
But it's all guesswork.I watched a good hour of this? I'm curious, how long does the full process take to get these bills through & enforced? or does it vary? with this being just shy of a month it would be delightful if this were to push through soon. I remember the days of illegal clamping (before i could drive) & i'd imagine that was addressed & delt with through a similar route.
In any case it is unlikely that any new law would be retrospective.0 -
