Parking Eye faulty cameras

Parking eye sent me a PCN saying that I had been in the Asda car park from 07:23 up to 11:45
To their credit they have an image of me arriving at 07:23:59 and they also have an image of me leaving at 11:45:16
The usual blurb £70.00 now but if I paid etc. £40.00
I appealed this because of the following;
I did arrive at 07:23 and left about 08:45 on the way home I pulled into a VW dealership at about 08:50 but they were very busy that so I thought I will call back later.
I then left and tried unsuccessfully to join the traffic but it was full of works traffic going the opposite way that I wanted to go.
When I finally managed to get back into the traffic flow I felt hungry and decided to go back to Asda, on the drive there I thought while I am in the area I will just pop into a local shop.
I drove into Asda car park at about 10:20 ish parked up and walked round to this shop at about 10:30 ish left there and went back into Asda for some food.
Had a walk round Asda then found something that I liked purchased it at 11:36 I even supplied them with an Asda sales receipt.
I then immediately left Asda that would be 11:40 I can’t think that it took me 9 minutes to drive 217m to the exit.
My first visit to Asda was 1 hour 30 minutes approx.
My second visit to Asda was 1 hour 20 minutes approx.
I supplied all the images etc.
They wrote back to me on 15 February
Thank you for your correspondence etc.
In order for Parking Eye to consider the appeal further we will require further evidence confirming you were not on the site for the time as stated on the PCN
They wrote back to me on 16 February
They gave me some glib remark about inconvenient etc.
The Parking Charge has now been cancelled and there is no outstanding payment due.
It makes you wonder why would they cancel it the following day, first letter 15 February second letter 16 February.
Well it transpires that I got Resolver involved and they decided not to pursue it.
But from a logical point of view it plainly apparent the camera caught an image of me arriving the first time but failed to record or see me leaving.
The camera failed to record or see me arriving the second time but recorded saw me leaving the second time.
Talk about joining the dots
I never did get an apology from Parking Eye because as far they are concerned they are always in the right.

This is a very common error in anpr known as double dipping, PE seem particularly prone to it , they know it is a scam but like the money it generates but would be daft to take this to court imo.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.
Parking Eye, CPM, Smart, and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They nearly always lose) and have been reported to the regulatory authority by an M.P.
Hospital car parks and residential complex tickets have been especially mentioned.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.You never know how far you can go until you go too far.0 -
Welcome to the world of double dip unfair PCNs!

Very common, and an 'outrageous scam' (Hansard 2.2.18).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This just shows how PE have a lack of office protocol and really do not know what they are doing.
In my thread you will see the following;
They wrote back to me on 16 February
They gave me some glib remark about inconvenient etc.
The Parking Charge has now been cancelled and there is no outstanding payment due.
So yesterday (15 March) I received a large A4 envelope with the words emblazoned on the front below the address window in uppercase;
DO NOT IGNORE - THIS IS NOT A CIRCULAR
The date of the letter is 9 March
The contents read as follows;
Reference: Parking Charge Notice - *************
Dear Sir,
We refer to the Parking Charge incurred on 08th January 2018 at 11:45, at Asda ****** car park.
We can confirm that this Parking Charge has now been cancelled and there is no outstanding payment due.
Please disregard our previous correspondence dated 15th February 2018 as this was sent in error.
Kind Regards
ParkingEye Team
Have you ever heard of the saying "the left hand does not know what the right hand is doing" well this is a typical situation.
The ironic thing, in hindsight I just wish I had not gone down the resolver route and let them take me to court.
County Court does not frighten me a boardroom of Directors is a whole lot worse.
Bye the way I was thinking of buying shares in Parking Eye what are your thoughts.
Finally why doesn’t a Director from Parking Eye come on the Forum and just explain what exactly is going on.

They have wasted your time, they know their ANPR cameras are not fit for purpose.
Do not forget that letter of complaint to your MPYou never know how far you can go until you go too far.0 -
I never did get an apology from Parking EyePlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Buying shares in Parking Eye ????
Do you want to profit from blood money ???
A parking Eye director trying to explain a scam ???
Where would he start ???0 -
Especially as PE must be worried theyll be let go - Capita are in trouble and need to offload dead wood, and a new parking bill could result in that.0
