Both my parents died recently and going through things with my sister we have have found that a number of years ago our parents paid out £10000 to put the property (now worth £220k) into an Asset Protection Trust to avoid Care Home Fees. A quick Google of these intimates that these may not be legal, are likely to be challenged by Local Authorities and could be the next Miss-selling subject.
Does anybody have any experience of these trusts and could we have a reasonable claim on behalf of our dead parents?

There has been widespread miss selling of these. Who did they pay to do it?

Judging by a long running thread in here somewhere your first issue may just be getting the money out of the trust . Are you able to gain control without going through them?

They almost certainly did this with some fly by night unregulated company. If that is the case then you have no chance. If they actually did this through a solicitor you might have a slim chance if it can be shown they acted unethically.
