Hi everyone, first ever post. Unfortunately I had to get IVA in March 2012. This started on 2-3-12.This in now over 6 yrs and I successfully completed IVA in JAN 15. I have one creditor that has put the date of July 2012 as my default date none of the others have. I have spoken to them, emailed got CRA to raise the issue but no joy at all. I have paid my dues and want to move on. Its making me stressed yet again. This company have been difficult from day one tbh.
Are they breaking any rules and if so what can I do.
Please help
Thank you
G

If that's the date they feel you defaulted on the account then it's correct.
Besides it will drop off later this year0 -
Hi, surely the default date is when the IVA started. As i wasnt making payments before then.0
-
The default date should be within 6 months of you defaulting. How does it fit with when you stopped paying?0
-
It's subjective. Personally I wouldn't worry. In 4 months it'll be gone for good and TBQH it is having little effect on your file as it is a satisfied default that is about to drop off.2.88 kWp System, SE Facing, 30 Degree Pitch, 12 x 240W Conergy Panels, Samil Solar River Inverter, Havant, Hampshire. Hi Thanks for advice. Its all very weird tbh. Equifax has me as excellent rating but Experian only fair. All so confusing.0
-
That would be because the rating and scores are made up and are to be ignored.0

The rules on defaults are different if you enter insolvency.
If you have had an IVA or any form of insolvency, then the default dates of all unsecured debts included in your insolvency must not be later than the date of entering the insolvency

You need to write a formal complaint to the creditor, outlining their responsibility to accurately reflect your insolvency on your credit report, refer to the debt camel article for guidance on this.
If they wont play ball, then escalate to the ICO :
