    How is your witness statement looking? You submitte it, and your evidence, on time yes? Usual deadline is 14 days before so I presume itis already filed...
  • Witness statement submitted with all my evidence. Trying to keep my skeleton argument brief and to the point. Didn't know the skeleton went to the other side so thanks for the direction on that.

  • Well today was the day. However let me go back to Friday. Gladstones emailed me to say that no one would be attending and they have asked the court to decide on the evidence they had provided. Shame they didn't get that message to the court because that was the first that the judge knew about it.
    In fairness he gave the claimant a chance, going though their evidence.
    It ended though after he looked at the signage. Case dismissed and after a chat he settled on £300 of costs to me, given their unreasonable actions.
    My moral of the story and one could write a book on this. Fight the ticket but be aware that it involves time and effort.

    Good win and good costs.

    I'm bookmarking this one as a classic example of how to follow through against PPC/Gladstones.

    They were using template signs, a template claim and a template Witness Statement - but the key issue as you pointed out at the beginning was the lack of thinking behind the selection of the template signs.
    Signs are misleading, contradictory, poorly positioned and mention a condition of parking that is impossible to meet, i.e. park in marked bays; there are no marked bays at all.

    It is a given, that any issues with signs will be fatal to a claim and yet they persist. Enjoy the money.
