The final sentence on the last page of the attachment is the key.
Wow, I don't recall reading that before, IamEmanresu. Lots to make your stomach turn, when reading that epistle from the infamous Patrick Troy.
The paragraph following the word 'fourthly' gives me another reason to detest the *work* of enemy of many BHAFC fans, Norman Baker MP. Encouraging TOCS to let private firms use fake PCNs to intimidate people, instead of following statutory byelaws.
Back on topic, there's no need for the OP to ask anything else, because the answer to this is yes:Shall i wait it out for 06 months and if I don't get any court proceedings letter then forget about it?
As confirmed in the Indigo Railway thread linked under the Q&A in the NEWBIES thread, that's all that is needed, apart from complaints to posters' MPs and to Sir Greg Knight.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You want to get this past six months when it becomes statute barred. Give Indigo the name and address of the driver.
Let us know what they say. If they don't accept the driver's details then you complain to the BPA.
In any case, you should complain to your MP.
These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):
''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.
These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.
I don't intend to respond to them any more. Can I ask if the 6 month duration for court proceedings start form the day of PCN or the day when debt collectors issue their notice? Also if one makes it beyond six months, can they still go to court even though they know that it would become statute barred and there is no case? Finally what is the general policy of ZZPS on taking keepers to the court?
This is my final reply to them. I can't volunteer the driver details of my car on the day of contravention to indigo as the appeals website is governed by ZZPS.
Dear Debt Collector
I wish you to note on your files that I deny any debt to you or your client [Indigo parking] as I have earlier mentioned about not being party to any parking contravention. I had appealed against the PCN citing my circumstances (clearly mentioned in previous emails) to the indigo appeals service (appeals@ipaymypcn.net) thinking that it was indigo parking but I have just realised that it is also managed by your agency which is very misleading.
Also you haven't responded to my offer of supplying you with information on the person who was the driver at the time of PCN issuance. I again state that I am willing to provide the information if it is requested.
Since you have no part in this issue, being merely being paid on commission, there is no reason to engage with you. I ask you to refer it back to your client. I will communicate with them directly should they wish to provide
*a copy of the full unredacted contract they claim to have,
*the basis for their claim - contractual sum, loss, or trespass,
*and evidence that signage was in place in the location stated at the time
Since you are unable to supply such information, it is pointless engaging in any more communication with you. I cannot guarantee replying to you, but I can guarantee I will pass on any further harassment to Trading Standards. You still haven't
Thank you.0 -
Date of PCN
They can attempt to bring a private prosecution to the court, however the magistrates should not hear it
ZZPS have never taken anyone to court. They certainly would not take someone to mags (the only place that can hear byelaws) as they literally pay out money and CANNOT get anything back.
Of course you can tell Indigo the drivers details, if you wish. This isnt an appeal any logner.
Those bullet points arent relevant for byelaws, surely? Youve copied that without confirming whether its any use.0 -
