The fourth sentence of post #20 would look better as:My gut feeling is i should just pay £60 as its true the driver didnt pay and he just sat in car with his 5 year old waiting for his wife.
Sorry to keep pressing this point, but if you want the protection of PoFA and no keeper liability, then these small things become significant.0 -
Yes, upload it under OTHER on the POPLA website. In the box just put:
Please see attached PDF appeal. The operator cannot hold a keeper liable because Smart Parking choose not to use POFA wording on their Notice to Keepers. See full appeal attached.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Why would you need to add anything else? Smart are so easy to beat at POPLA it's laughable.
I even gave you the massive hint as to why your uploaded appeal will win, when I said:The operator cannot hold a keeper liable because Smart Parking choose not to use POFA wording on their Notice to KeepersPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
