Can anybody advise me? PPI

Hope somebody can help me.

7 years ago, tried to claim PPI from Marbles. They were very difficult to deal with and in the end I gave up ~ they said I didn't have PPI, then I did but they hadn't charged me anything, then said I did and then I didn't once more.

Having recently won with two other credit cards on the very same basis, I called Marbles and asked 'did I have PPI?' They wrote to me and said 'it commenced Jan 12 2003 and you cancelled it July 4 2009'

Now they're saying 'you may have had PPI but we didn't charge you or at least we can't see if we charged you (even though you had PPI from 03 to 09' therefore we are not obliged to pay you.

Can anybody help? I have their letter stating I did have PPI and as I mentioned, my argument succeeded with two other companies. Thanks in advance.

    A credit card can have PPI on it but you may never pay a penny. For example, if you pay the bill off each month within the interest free period, then no PPI is charged.

    Firms hold onto copy statements only for a set period. That period varies with different firms. It also changes if you are a current customer with them or an ex-customer (current customers tend to be held onto for much longer than ex-customers). The fact you had two other companies doesnt help you because their periods would be different.

    If the firm has no evidence that you actually paid PPI then they cant refund anything on a successful complaint. If you have any copy statements showing a PPI premium being paid then they are required to use your copies as evidence. If neither you or they have any evidence PPI was paid, then it is game over.

    It's confusing because the other two card companies came forward and paid out on the basis that they'd failed in their duty to explain whether PPI was appropriate in my case.

    With Marbles, I would never pay the balance off each month ~ when I initially tried to cancel the PPI they said it was tied to the interest rate and advised me not to cancel, then raised my limit.

    As I mention, they've written and said I definitely had PPI during 03 to 09 when I cancelled it.

    So, they not only reviewed your complaint, they also had a record of what PPI you paid. Marbles have no record of any PPI that you paid. So, they probably havent even looked at your complaint reasons. There is little point looking at the content of the complaint if there is no evidence that you paid any in the first place.

    Also, just because two firms say they failed, does not mean a third firm failed in their duties. Every firm had its own process.
    As I mention, they've written and said I definitely had PPI during 03 to 09 when I cancelled it.

    And as I said, it doesnt mean you paid any PPI. And that is the issue. Not your reasons for complaint. The fact there is no evidence you paid any PPI is where yours is stuck.
