I received a PCN from Excel Parking Services Limited through the post, issue date 26 09 2017, advising a contravention date of 03 09 2017. The contravention reason stated that my vehicle was parked without payment of the parking tariff for the vehicle registration mark of the vehicle on site
The maximum period allowed at this site is Minutes - this was incomplete.
The notice shows pictures of my vehicle and time of entry at 13.16.00 , time of exit 13.58.29, duration of stay 42 minutes. There is no proof the vehicle was parked in a bay but just the times entering and leaving. The site was the Peel Centre in Stockport. I was given up until 24 10 2017 to pay this charge.
Although I am the registered keeper, I had use of a company vehicle at the time and was not insured to drive the vehicle. Instead another family member had use and paid insurance and tax to drive it himself.
I appealed on the basis that there was no keepers liability due to the fact that the notice was issued 8 days after the deadline, therefore I was not liable. The date given of contravention was 03 09 2017, therefore the PCN should have been received no later than 18 09 2017 but was issued on the 26 09 2017. Three letters were submitted by me recorded delivery and dated 09 10 2017. The letters were addressed to Simon Renshaw- Smith for addresses I found on google and also to the address of the for Excel Services issuing the PCN.
I had not received any correspondence from them until today when I received a letter from their central payment office in Sheffield. The letter states that due to an administrative error they have been unable to process my appeal and that if I want the points in my original appeal to be addressed, I must resubmit my appeal.
It goes on that if I am not the driver etc....and wish to transfer liability I can do so by visiting their portal.
Submit my appeal or pay the charge. As a goodwill gesture, they have extended the deadline to appeal and are also willing to reoffer the reduced amount of £60 as full and final payment of this new notice if paid on or before 14 March 2018. Failure to pay includes the usual threats.
Any advice would be gratefully received.

I would appeal on "out of time" and use a successful appeal from this forum . Use the SEARCH for "out of time".
But you already have evidence of their incompetence as provided by their "administrative error" so should be a breeze if it went further.0 -

Or you could simply tell them to go swivel. Tell them they have your appeal, it's been signed for. Their administrative errors are no concern of yours. If they want you to sort out their own administrative incompetence, you are prepared to resubmit the appeal on payment of your own administrative costs of £100.Trueblue60 wrote: »Submit my appeal or pay the charge.0 -
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.
Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (who take hundreds of these cases to court, and nearly always lose), who have also been reported to the regulatory authority.
The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.You never know how far you can go until you go too far.0 -
