    Can they still get court action even if the debt is over 6 years old and I have NOT sent the letter?

    They can TAKE legal action, but, provided you put, in your defence, that you are not paying the 'alleged debt' because it is statute barred, then the judgement will go against LOWELL.

    SEND THE STATUTE BARRED LETTER NOW.

  • I've just come off the phone to yet another advisor at lowell. I'm trying to arrange a repayment plan with them to start in January but as I've defaulted on 2 payments they are unwilling to do this and are threatening me with litigation. (I've been out of work for the last 2 months but am starting work again in January therefore I can start paying back what I owe.) I can't afford to make any payment til the end of January when I get my first wage but they are insisting that I make a payment now! I tried to explain that I had no money til the end of January but it fell on deaf ears!
    What do I do now????

    Do what I did, just keep on at them, and as soon as you can make the first payment, make it to show goodwill. whatever payment plan you offer, stick to it, whether they agree it or not. They will find it almost impossible to slap a CCJ on you if you have been making regular payments.

    oh and don't listen to any of their nasty comments. tell them any calls they make to you will be recorded and insist on correspondence in writing only.

    they seem to employ people who get a kick out of being horrible to people in a hard situation already. don't let them get to you.
