    Don't mention cheques, they are a very sore point at the moment, especially when those that issue them cannot get the details correct so I can cash the bloody things :D

  • and how stupid is this.... a post card (which came via the post!) saying "we called on you today and sorry we missed you, we will be back after 5pm today unless you call! Doh, sent with a second class stamp on it!

    My sister had one of these. I laughed all night when I first heard about it. :D

    Her debt was statute barred.
  • Lets say I just dont contact them, what would their next step be. If it turns out it is statute barred are they able to get a CCJ without me knowing? Ive not posted the letter yet as I was keen to see what they will do next. Is this un-wise?
  • pot the statue barred letter first RECORDED DELIVERY so you can obtain proof on the royal mails website with the number to show it was signed for!!

    then wait..

    if it isnt showing on your credit file then likely it is statue barred

    Deviant if you do nothing you can bet they will continue enforcing it whether it is statue barred or not. Unless you send the letter they will disregard it. Remember it's up to them to provide proof you have made payments / contact within the prescribed time frame. Sending the letter gives you everything to gain and nothing to loose, just make sure you send it recorded delivery

    I have seen a few different versions.

    Can anyone give me the link to the best or most up to date please.

    Ive not herd from Lowell this week, any idea whats up their sleeve next???

    Hi deviant - use the letter in the following link:

    Leave out the words 'WITHOUT PREJUDICE' and insert, as the first sentence:

    "I do NOT acknowledge any debt to your Company or to any Organisation you claim to represent"

  • Hi all, I never sent the statute barred letter after all, I guess I was too worried what would happen if it turned out it was not quite statute barred. Ive always been one to stick my head in the sand. Cant help worrying.

    However its been 2 weeks since Lowells last letter to me (all of which were the standard call us now type) and I have not herd anything further from them. Any ideas why? What are they up to now?

    Perhaps I should just leave it? Maybe they were just trying to provoke a response to see if the new address is my current address?

    Or are they quietly about to do something like drop a bomb shell from the courts?

    Your views?
  • Oh, forgot to mention Ive not changed my address with experian yet, when I logged in using my old address I saw that Lowell had made a search of me with my old address still active. Might make a difference?
  • Ive just had a further letter from Lowell saying their agent has not made contact with me and in 7 days they will pass the account to their legal department.

    I have NOT sent the statute barred letter.

    Can they still get court action even if the debt is over 6 years old and I have NOT sent the letter?
