Re pip fraud

Options
Hello everyone.
Hope somebody can help. I went to an interview under caution 2 weeks ago for pip. Stated they have cctv of me walking more than I stated on my forms. I have just recived a letter today stating over payment is £10.500 from August 2015 until July 2017.
They filmed me January 2017. But have taken the claim back from the August 2015. What will happen. Can I appeal this and state at the start of my claim I couldn't walk which was true.
Is this a lengthy prosess when will it go to court. If I appeal what's the time frame etc.
I'm married 2 babbies.
If anyone with advice could comment
Many thanks Mark

If you're condition had changed it clearly states this on all letters that you MUST report those changes. There's not a lot you can do if they have video evidence of you.

Where there is evidence of fraud it's not unusual to reassess the whole award. Such a large overpayment may well be considered for prosecution also.

    Your 2 babbies are irrelevant.

Yes, you should have completed a permitted work form.

Please start your own thread Oscar, so as not to distract from Mark's query.

I think you should seek specialist advice from benefit advisor (Try citizens advice or your local council )

    or go to https://www.turn2us.org.uk/Benefit-guides/Fraud-Investigations/What-is-Benefit-or-Tax-Credit-fraud

This happened to someone that I know but the DWP only took the money back to the date of the CCTV footage

They only have a limited time that they can move forward

Prosecution must begin within three months of the date from which there was sufficient evidence to prosecute or twelve months from the date of your offence, whichever is later.

    good luck

Would have to disagree with this, if its dishonestly failing I am sure they can prosecute at any time.

The problem the DWP will have proving fraud in any PIP claim is the 50% of the time requirement, so it follows that for the other 50% of the time your fine, this applies to the daily living and could also apply to the mobility part as well.

Hope they are starting to do this more, they could start by filming the disabled bays at supermarkets!

Not all disabilities are visible! For instance, there has recently been a case of a van owner being reported for parking in a disability bay - for him to respond showing his prosthetic leg.
