Applying for 'change of use' before moving home

    I am getting access to the transfer form for the property, from the land registry, which contains all of the covenants.

    I am willing to lose the property - if they aren't willing to wait (even though they are yet to find a house) and want to pull out then thats fine by me - i'm not moving house unless i can run the business from the garage.

    Basically, it's either they allow me to go through the process trying to obtain PP, or its a deal breaker.

    Genuinely not having a go here but I am interested.

    Can I ask if you have contacted the council as Doozergirl suggested. And, if not, why not.

    In my volunteering and on here I am still surprised that people haven't picked up the phone and asked the question before going online and/or visiting an advice agency. In your position I would have done exactly what Doozergirl said. I can understand raising a query and not understanding the answer/or thought it was wrong etc. But surely ask first

    Yes I certainly did follow the advice Doozegirl gave.

    I phoned the council and they were not clear on their response.

    I spoke to two people as I wasn't 100% sure the first was confident in their opinion. One said I would need planning permission and also change of use, and the other person said I may need It but not too sure so I had to email another department.

    Ideally I want to speak directly to a planning officer to see if I am likely to get accepted before applying for planning permission and change of use

    Anyhow, first things first I need to confirm if there are any covenants restricting me.

    Incorrect.

    You can apply for a change of use application on other peoples property, though you need to notify the owner that you have submitted the application.

    Should the application get approved, but the OP didnt by the house, the actual owner will just not implement the application and so a change of use will not take place.

    You should be fine in terms of timescale, this sounds like minor development so should be turned around in 8 weeks.

    Dont expect an officer to be able to tell you over the phone if you are going to get permission, they need to carry out consultations as part of the application so you will not get a firm yes/no by verbals.
