33 day until NTK ?

I have recently been threatened with ccj and court action due to an unwarranted unpaid ticket issued by excel parking cowboys on 18/11/17 at the peel centre car park which i recently learned to my horror is free for 30 mins. I shopped for 49 mins in the pet store on the car park. As my car was being repaired I was in a hire car after returning the car the company issued me the first parking charge on the 12/01/18 33 days after alleged contravention more followed I ignored them after some questionable guidance I have recently read in the newbies thread that due to being a hire car it should of been addressed within 21- 28 days I did not reply in time frame culminating in £160 new charge plus threats of court of BW Legal summarising the car park is poorly signed on my return to investigate plus the £100 charge for 19 min over sight seems excessive please help!

Not much you can do but wait to see what happens. The ball is in Excel's court, but at the moment you are just receiving threats.

The time for action is if you receive a formal Letter Before Action/Court Claim from Excel (or BWL) or genuine court papers.

In order to be prepared should either arrive I would read the NEWBIES FAQ sticky, post #2 which provides full guidance on how to deal with a court claim.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Get pics of the car park, entrance and signage.

If you have not contacted them at all yet, send a late appeal using the hire/lease template from the NEWBIES. Again, if you haven't yet contacted them, edit your posts to remove any information about who did what. Only ever refer to The Driver, The Keeper, and The Hirer.
If they already know who was driving, then this is irrelevant.

Start reading up on what to di if you get a LBC/LBCC/LBCCC/MCOL using the NEWBIES, especially bargepole's excellent guide to court.

Complain to the landowner. Tell them what MPs have said about this scam.

    Complain to your MP.

These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

When you want to update, please don't use a phone and no new thread.

Just reply on the first one and let this one die, now.

And the definitive reply you had is very good, but it is a standard one you could have read on ANY thread! You will benefit most from this forum if you only reply on your own thread, just one, but read LOADS of others every week.

We read EVERY thread, every single day, and most of us regulars also work.

Newbies who read every thread learn quickest, and you'd have seen the stuff about the Parliamentary debate, a whole month ago!
