PPI & Barclays pre-2008

Hi Everyone,
I've had one hell of a time with Barclays and an old mortgage I held with them from 2003 - 2007. They lied to me for months, saying there was no PPI on the policy...but have finally admitted that there was. However, they now say that as the PPI was taken out in branch, we would have been told about the details/risks and so it wasn't mis-sold. I've read about the 'Plevin' case, where simply having PPI is enough to claim back money but it does say that involves cases from 2008 onwards.
They also state...."When we investigate a complaint about PPI we will check if you are affected by the Supreme Court ruling. Unfortunately, we are unable to give you an answer at this time because we are waiting for the Financial Conduct Authority (FCA) to confirm their final rules and guidance about commission. This guidance will make sure that all companies regulated by the FCA treat complaints about commission in the same way. We are unable to advise you when the FCA will make this information available and we are sorry this means that some of our customers will be waiting much longer than we would like for a full answer to this issue"
They have treated us disgustingly over this...is there anything I can claim back, now they finally admitted it existed? Or am I powerless, as they say I am? Thank you.

No, you can't make a complaint, as you're outside of the time scales.
They won't have lied to you - they'll just have struggled to find the correct records from that far back - one of the side effects of adherence to the DPA.
Also Plevin had never meant that simply having PPI means your were mis sold. It just increased the likelihood of a commission based payout.0 -
Thank you for your reply. They did lie to me - they told me more than once that there was no PPI policy on my mortgage and they considered the case closed. It took months before they admitted there was, with no apology or explanation at all. What a shame they don't allow claims for older mortgages, it is certainly not something we would have agreed to by choice.0

That doesn't prove they lied to you. A much more realistic, though dull explanation is that the records were not easily available.
It's incredibly difficulty to brief low paid staff to lie to customers and expect them to take that secret to their grave. The would end up having to murder them all and that gets very messy.0 -

MPPI is harder to find than loan or credit card PPI. MPPI is a standalone plan. Its one of the reasons most MPPI complaints fail. The fact it is standalone means it is not factored into the mortgage and there are no codes against the mortgage to say you had it.What a shame they don't allow claims for older mortgages, it is certainly not something we would have agreed to by choice.
Assuming you mean complaint, rather than claim, then they do allow you to complain on older cases.
It is only Plevin that wont apply to you and that is because you didnt have the mortgage in 2008.I am an Independent Financial Adviser (IFA). Regardless of you having had PPI, your complaint then failed or a Plevin refund would not have even been considered in the first place.
Certainly it's frustrating to be told first that you didn't have any PPI and then later having this information corrected, but you had mortgage PPI for which most complaints fail anyhow.
For you to have been "lied" to, the Bank would have had to know already that you had PPI when they told you that you didn't. This is very obviously not the case.
It was a mistake which didn't impact negatively on you because your subsequent complaint was rejected in any case.0
