Claims Advisory and Plevin

In 2015 I rather naively signed up with Claims Advisory Group as they kept ringing and pestering me to sign their forms.

They failed to reclaim PPI for me from the Halifax.

After watching Martin Lewis talk about Plevin on a recent show, I filled in an online form with the Halifax and have been awarded funds due to Plevin.

Claims Advisory are now aggressively pursuing me for 39% of the award. This is the first contact they have had with me since signing the forms in May 2015. I didn’t receive anything from them when the original PPI claim was unsuccessful.

Has this happened to anyone else? They are very threatening in their approach. I emailed them twice since they text me their invoice - asking for details of my contract with them. They finally responded today after a bit of a telephone stand off between me and the advisor.

Is there anything I can do? Are they entitlee to 39% of my Plevin even though I claimed that myself? How long can CAG hold my details for? Please Help!!

In which case they are acting potentially fraudulently (Ministry of Justice words - not mine).

Yes it has. However, it is not unexpected when you deal with such companies.

Tell them to F off. Really, that is what you do with fraudsters.

No. Read what the Govt say. In particular, point 3

You should let the legal ombudsman know. too many of these CMCs are doing this and I bet you a good number of people are paying who shouldnt be. (this has come up a lot on the forums)

  • Thank you for this @dundtonh

They are so threatening in the approach. They also gave me 1 day to settle the invoice. Letter dated 21st Feb with deadline for payment of 22nd.

Do I need to officially complain to CAG before I can contact the ombudsman?

Yes and you need to give them eight weeks to respond.

Make sure that if you do have to refer your complaint it goes to the Legal Ombudsman (not the Financial one)

Whilst the complaints process requires you to complain first, the Legal ombudsman have replied on this site a few times and told people who have had CMCs doing bad things to contact the ombudsman straight away.

Remember this is not a dispute over service. This is a claims company breaking the published rules and acting in a way that the ministry of justice said could be considered fraudulent (in respect of billing people for things they are not entitled to bill for).

  • I rang the ombudsman today and they have sent a letter on my behalf to Claims Advisory Group. Fingers crossed they will now stop the multiple daily calls and texts asking for money!
