When my Mum died in November - we had three days from death to clear her room of its all contents in the CH - this was part of the contract. Normally CH have a list of people waiting to come in and the rooms get filled very quickly. I was given the money kept in the safe, which belonged to her and they returned the overpayment of fees - within 3 days and made payable to me (rather than the estate). I thought they were pretty efficient tbh and gave us a reasonable fund to deal with the expenses following her death as getting cheques made payable to the 'estate' can be problematical

Wow a whole 3 days. We had 24 hours & at 23.5hrs they were already wheeling the new incumbent's bed down the corridor & her clothes were already in the wardrobe. No money involved though as mother was self funding & if we left any clothes they would have gone into the pot for those who weren't self funding. We left the highly prized blankets with sleeves though, along with other stuff.

The care home are on very dodgy ground in this situation. They have no legal right to dispose of the items or appropriate them. Whilst I can understand their wish to clear the room they are abliged to store the goods for a reasonable time and can in theory be made to compensate for any losses. The problem is that the items may have little real open market value even if they are sentimetally valued.

I should point out that the CH charge for those 3 days, even though my Mum had died. We were aware of this as it was in the contract. TBH once my Mum had died, we just wanted to clear the room as soon as viable really as not a particularly nice task to do.
