County Court Business Centre Judgement

Hi All,
I have been reading the newbies section and it advised me to start a new thread. I live in a block of flats and after 5 months of living here the landlords (at that time) took my temporary parking space away 13 months earlier than first said. Because of this I often have to park in the permitted car park at the front of the building for loading and unloading. I was told I was allowed to park for up to 15 minutes without worrying about tickets (however, had have a few within this time limit). I will admit sometimes I have stayed a little over the limit. When this has happened I was advised by reception to ignore these tickets as the company is not recognised by the government. Many letters have now ensued and again i was advised to ignore. It has now got to the stage where I have been sent a county court judgement letter and I am now starting to worry. I have read that i should have appealed sooner but the pre-county court claim letter got mixed up in my mail so I missed it. Am I still able to appeal? What would you advise my next step to be? The latest letter from the CCBC says i need to make a payment by the 16th March. Thank you so much for any help in advance!

    A County Court Judgment letter?

    So you have ignored County Court Claim letter and now have a County Court Judgment against you?

    Please confirm.

    Do you mean you have a CCJ, because you ignored court papers?

    WHY would anyone do that?
    I live in a block of flats and after 5 months of living here the landlords (at that time) took my temporary parking space away 13 months earlier than first said.
    If you have proof of this (i.e. the parking bay being taken away sooner than promised in writing) and the same company 'reception' told you to ignore the charges, then you may well have a case against the managing agent/reception for your losses.

    Saeed v Plustrade covers the issue of a managing agent taking away parking spaces.

    If you have a CCJ letter because you ignored court papers then kick yourself and pay it within the 30 days to protect your credit rating, and then look to sue the managing agent...IMHO.

    Or, did you never receive court papers? Beginning of this year, probably.

    It sounds very much like you ignored court papers. If you did then pay up ASAP.

    I unintentionally ignored the claim letter. I was waiting for it to arrive and when i hadn't received one i assumed they had just given up. It wasn't until i received the judgement letter that i realised they had sent one and it had just gotten mixed up in my mail. The most recent letter is titled 'Judgement for claimant (default)

    The claims letter got mixed up with other mail so I didn't see it until i received the CCJ (I assumed they had not taken it further). I can check previous emails regarding the parking space being taken away early. As for reception, I fear they will just deny that they ever said to ignore it, even though I was also told by them they have never seen the parking tickets go to the court stage. I have previously called to appeal other tickets and was told there was no appeal process by UKPC (rather aggressively) so I believed this to be the case and ended up paying them. It is only after reading through this forum I now see this is not the case.

    It looks like you have done everything this forum advises not to do. Ringing is a big no no as they lie.

    As this is a default judgment pay it unless you can live with a ccj for 6 years. Some people can avoid bailiffs etc so depending on your circumstances it's a case of paying or hiding.
