I replied to both national & franchise saying they had a duty of care to their customers and that if i lost my appeal, I'd consider small claims action against them for any loss. Neither replied..
Keep reminding them to respond until they do. I got a result for a friend by doing this, we sent fresh queries to McD customer services instead of simply replying to the existing email trail. Follow up by phone as well.
  • Ignore the muppets as you can only engage with their conversation , let them send you letters after letters, I gave there letters to my solicitor who started to bill them for reading them , they soon stopped writing and stopped the harrsement! Cowboys without a cause
  • If it’s not from the council or police, ignore the jokers, they can not do anything until they take you to court. And they will never win ! If you are worried send them monopoly monies to keep up the entertainment with them :rotfl: is

Really? I think you need to do more research, this is really bad unhelpful advice, and disturbing that your first two posts should be so misleading for those seeking proper help!!

Have you mentioned this scam on Facebook/TripAdvisor?

Thanks for all your replies. I appreciate you time.

    Coupon Mad:
You will find they don't do court, so nothing else will happen except ignoring letters.

So are you saying, following an expected win by MET via my popla appeal, that I should just ignore any further correspondence with them? I'm happy to do this but, since I'm doing this on behalf of my son, it's probably really him who is liable and I don't want to adversely affect him or put him in a situation where he has to fight this.

The PoPLA decision is not binding on the motorist.

    There is no liability.

Nobody pays these scammers unless a judge says so.

Just make sure your son ignores the toothless debt collector letters that will probably follow, and only responds to a LBC etcetera.

Complain to your MP as well.

These are some of the comments made by the MPs in Parliament concerning the unregulated parking industry (Feb 2018):

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

Point out the same words to MuckDonalds to show them what our Government thinks of the people they employ.

You should also get in touch with Mc Donalds again, and tell them that they must instruct their agents to cease and desist from
    pursuing this matter
    Hi. Here's the short version:

The manager actually in McD said once the ticket was issued there was noting they could do, which I doubt and maybe I wasn't insistent enough.

I contacted, via email, McD national who referred me to the franchise owner of this particular McD who basically fobbed me off (email again) with a copy & paste reply about protecting the car parking for all customers etc etc.

I then mailed both of them back (national & franchise) stating customer dis-service, duty of care to loyal customers and also said if I was forced to pay this MET invoice, I would issue them (franchise) with a small claims order for any sum I was out of pocket.
    Neither replied to this.

The Franchise owner will be liable for the actions of its agents, ie met parking, Who is the Franchise owner?

before you send/email anything post it on here for analysis - keep it all on their thread

Is your son the registered keeper of the vehicle? If so, are you putting his name to the appeal, not yours?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Yes, this is correct. He's the registered keeper and we've done everything in his name but not named the driver.
