Have tried to reclaim packaged account from HSBC re Midland account. HSBC say we are not liable. Any advice please?

HSBC bought Midland Bank in 1999. They are liable, as far as I understand it. If they won't engage further then escalate the complaint to the financial ombudsman.

Think the OPs problem will be proving liability, Midland bank to HSBC Group to HSBC Europe to HSBC UK. At some point you can guarantee future and past liabilities weren't transferred0

I'm going to go out on a limb and say that rather than "deny liability" HSBC have simply rejected the complaint.
HSBC are actually rather good at taking responsibility for things Midland Bank did, largely because unlike some other banks which have passed through multiple layers of ownership (e.g. Lloyds + TSB > Lloyds TSB > some to Lloyds, some to TSB) there's only ever been, as a corporate entity, Midland Bank plc which became HSBC Bank plc and some/most of which then passed almost wholesale to the new HSBC UK in recent memory. If you were with Midland or HSBC pre-UK then HSBC are liable, simple as.urs sinserly,

I wonder when they were talking about liability they were referring to time bars. i.e. the requirement to raise a complaint within 6 years of purchase or three years from being reasonably aware of an issue. (if the account was closed years ago then the three years applies from closure and its way past the 6 year point).
Or it could be a straight rejection. Not unexpected as most PBA complaints fail and the FOS is only upholding around 13%.I am an Independent Financial Adviser (IFA). Why would they be liable for something that happened and ended over 25 years ago? Surely it's so far out of timeRemember the saying: if it looks too good to be true it almost certainly is.0
