van broke down within a week, small claim court?

    Start putting things in writing. Tell him you are rejecting the vehicle and want a refund.

    Thanks. Get really stressed these two weeks. I may send a letter to the seller not sure whether I will get any response.

    Probably not but if this gets to court a paper trail is always a good thing.

    In what way did you contact the seller? In writing?

    When you say that in the beginning he didnt answer you, how long was it from initially contacting him until you spoke to him?

    Was it him that told you to take it to a nearby garage?

    What EXACTLY did the advert for the van say in the description?

    Normally you need to give the seller an opportunity to put right the fault. By taking it elsewhere (unless he told you to do this) then you may have made this rather difficult.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
