DWP Compliance Officer refusing to return forms

Further to my two previous posts I have spoken with the Overpayment Team who advised, contrary to what the Compliance Officer informed me about the reason for the review, that HMRC had sent them an annual tax savings summary for April 2015 - April 2016 and I had not provided a bank statement for the savings account they had referred to and as such a decision of overpayment was reached. Why they could not have contacted me and asked for this before passing a decision is beyond me as now I have to follow the Mandatory Reconsideration route! I telephoned the Compliance Offer to whom I had delivered all the relevant documents to and without even trying to understand what I was saying she ruled "if you didn't give me the document I wouldn't hav sent it so they are right to make their decision". I asked for her to forward me all my documents which she said she had scanned and emailed so I wasn't wasting time duplicating them and more importantly provide more supporting documents (even though DWP did not specify what information they used to make the overpayment decision) her reply was "unless the case is closed I can't return your documents and seen as you are going to request for MR then it means it's going to remain open" when I posed further questions to her about why certain documents were present and others not when I printed them off as a job lot she let slip that she had had 3 cases since mine where documents were being misplaced before reaching the DM! I have an appointment with her to view the hard copies but wanted to know if this is normal practice? At the end of the day it's information I provided in the first place and it's not like I can destory any document from the original as she said she has a scanned version.

So ask for a Data Protection Subject Access Request on all data held for DWP to make the decision.The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0

Sorry for jumping on your thread but I am struggling to find where I can start a new one?? I basically had a letter from customer compliance yesterday. So this morning I rang them to see whats up. They asked me if I had 48 grand in savings in my natwest and a morgage!!? I am on esa support and pip enhanced care with -£1000 pound into my overdraft and 0 savings. They decided to conduct the interview over the phone and they asked if I have these savings or anything over £6000 pound or a morgage , I said no most definately not and offered to send in bank statements. He said as far as they are concerned the matter is over and I dont have to attend the interview. He said they get glitches sometimes on the computers and that a person of the same name who has these assets have maybe been flagged up as yours! Unbelievable really but Im glad its dealt with. Just a heads up for anyone worrying about an interview, maybe give them a ring and it could be dealt with quickly over the phone.0
