Hi
I recently lost my ESA medical followed by the MR, so I am going to appeal. I was receiving income related ESA and help with my mortgage SMI. Could anyone please tell me once I receive my appeal date will my SMI be reinstated. I live alone with no other money coming in outside of PIP.
I did not sign on for JSA.
I know SMI is turning into a loan from April and have sent back the paperwork in agreement, should also say I am not on UC.

Thank You.

You do not have to wait until the appeal date to have your ESA and SMI reinstated. As soon as your appeal has been accepted then you can claim ESA and SMI again. Once you have sent off your appeal then after a few days ring the DWP and tell them. Once they have received confirmation of your appeal being accepted then they will reinstate your ESA and SMI.

This should be backdated to when your ESA stopped

Not sure it answers your question, but when your appeal is lodged with the TS (and noted as such by the DWP) you can request ESA payments are resumed pending the hearing (in most cases).

Restoration of ESA pending appeal para.

I think if successful your SMI will also be backdated.
