    I never suggested the OP should return the dog if she wants a full refund, though I did suggest that was maybe the only alternative.

    (I also suspect the breeder is deliberately claiming the animal would be destroyed in the event it was returned to her)

    OP should answer this. If insurance doesn't cover the X-ray (and also has an excess) then these are legitimate costs they can claim from the seller.

    So basically, you want to keep the dog but want a refund of the purchase price even though you can claim on the insurance to pay for his treatment?

    I doubt the breeder will agree to this and I doubt you'd have success in any court on those terms.

    Either you keep the dog and claim on the insurance or you get a refund and the dog's ownership reverts to the breeder.

    The OP is doing the breeder a service by taking the faulty item off their hands free of charge. In it's current state it has no value, and the breeder would incur costs disposing of it.
