Can garage sell my car
Hi All,
First of all hello, as this is my first post.
It is quite a strange one I have but I hope I can get an answer with your help.
My car broke down about three months ago, AA towed me back to the garage where they said the engine i seized and pretty much not worth fixing it (Astra 1.7 CTDi 2008 reg). They offered help with scrapping it and asked if I can bring logbook for this purpose.
Next day I showed up with the logbook and... pretty much forgot about whole case as I had quite a lot of other priorities.
So its almost end of February, car broke down in mid December. I have not received confirmation of my car being scrapped or anything else. I would not remember it if my friend have not told me he saw my 'scrapped' car being advertised as 'to sale' for 2k pounds with photo of this very car on garage's front yard!
I feel pretty much ripped off by the garage and annoyed they did not even bother to change the name on V5 book.
My question now - is there anything I can do to recover either the vehicle itself (as I am technically the owner) or money if they sell the car? No, I do not have a spare key
.
I do appreciate all your help in this matter.
Thanks a lot

Did you receive any payment for the "scrap", or did you agree to give the car to the garage for "scrap" to cover a bill or something?
If you sold it/gave it away to them then they can do what they like with it.
Most likely they sourced another engine and got the boy to fit it in dead time in between jobs so it cost them nothing to fit, whereas you would have had to pay a lot of labour charges and the cost of the engine, plus storage while they were getting it, so it wasn't worth you paying for the repair.I want to go back to The Olden Days, when every single thing that I can think of was better.....
(except air quality and Medical Science)

I'm sorry, I just don't believe someone would just 'forget' about their car.0 -
If you thought it was scrapped and it's been 3 months I don't see a problem with garage putting it back on the road - will have been viable for them but not you.camelot1971 wrote: »I'm sorry, I just don't believe someone would just 'forget' about their car.
I think he's saying he forgot to check it'd been registered as scrapped with the DVLA.0 -
If they agree to scrap it then I don't see how they had the right to do anything but that.
Have you anything in writing, did you owe them any money?0 -

A garage don't change the name on the V5, you would have given them the V5 either to scrap or to sell to them. There is a specific section for selling to dealers. What exactly did you give them and get back?Remember the saying: if it looks too good to be true it almost certainly is.0 -

It depends if it was "sold for scrap value" or "scrapped" (as in, sent to be destroyed).
In either case though; what's the loss/claim? Surely you'd be glad a car avoided the scrap heap and associated environmental damage?0 -
Let's get down to business
How much do you want OP?1 -

I have sold about 3-4 cars for scrap over the years. I use to just drive my work car (our second car) into the ground.............it worked for me. They gave me scrap money for it to be scraped. By that I meant broken up. I did not want it going back on the road for my own peace of mind and any comeback for tickets and the like.
That is the contract I had and that's what I expected. Its not about loss or gain.......its an agreement that I expect them to honour. Of course I ensured I filled in the V5 anyway. So in my case it was not an issue.0 -

"sold for scrap value" or "scrapped"
What do you think they meant, its obvious what the person who was there thought?0 -
Tbh, I think you walked right into this one. You could have easily transported the scrap back to yours and sold that. You could have sourced a new engine.0
