Appealed Indigo and they rejected - what can I do

Hello,
The driver received a penalty notice on the car from Indigo Parking solutions on the 25th Jan for 'not correctly parking within a marked bay'. As far as the driver was concerned they had parked in a marked bay - there were white lines in front and behind the car - like all other spaces in the car park. Unfortunately the keeper did not look them (Indigo) or this site up online before they appealed - and 20 days later Indigo rejected the appeal.
However this week they (Indigo or Southern Rail) have drawn the lines in the car park again - and the space the driver had parked in has been identified as a marked bay.
There are pictures that were taken on the night the ticket was issued, the rejection letter with images that show nothing but the car in a space, and the pictures with the space clearly marked as a bay.
Is there anything the keeper can do, besides pay? - the keeper has 9 days left before it goes from £60 up to £100
The keeper has contacted Southern Rail who own the land - but they are useless. There seems to be no point in responding to their (Indigo's) appeal rejection.

ignore them and let it time out after 6 months

edit your last post to remove any hint of who was driving , these companies monitor forums like this one

the DRIVER was the one parking on the day

the KEEPER is the person who received the letters

I'm guessing as Southern Rail are involved this was at a train station? If it was why do you want to do anything?

All Indigo can do is send you scary letters. That's all. Do you get worried by scary letters?

It was in a Southern Rail car park - but Indigo manage it. The keeper contacted Southern Rail in the hope that they could help.
The keeper is not scared by letters - but Indigo now has the keeper's details - so could they take the keeper to court? The keeper could pay (even though the principle of it makes the keeper angry) if that is a possibility - but would rather not because Indigo are in the wrong.

Carlz, you need to get it clear in your head that the driver and keeper are two different people.

Indigo do not have the driver's details - unless you have told them who the driver was.

It matters not whether the driver is scared of letters. The driver is not going to receive any letters. As Redx said above, it is the keeper that gets the letters.

Now... think about that carefully and edit your posts appropriately.

if the driver broke the bylaws then the TOC can take them to magistrates court, which was always the case if the driver broke the bylaws

because bylaws apply, the TOC have 6 months to take the driver to magistrates court

    so IGNORE indigo

its a complicated issue, so read all the other INDIGO TRAIN STATION threads until you understand

INDIGO do not have the drivers details unless you revealed them in your appeal

Get paying out of your head. Indigo would not get a penny if they launched a prosecution.

Why would they splash out to take you to court then get the square root of chuff all in return? These companies rely on maximum return for minimum effort. This would give no return for a great deal of effort.

The details were most probably revealed at appeal because name and address are required fields by Indigo

You will learn so much more just by searching the forum & reading the dozens of other people, all currently dealing with Indigo Railway PCNs and complaining to their MP about the lack of POPLA (despite the PCN offering it).

All just happily waiting for the PCN to time out.

6 months goes quickly and NONE have gone to Mag's court. Other threads explain why not.

Search for the 2 words 'Indigo Railway' and settle down with a cuppa to read them all.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
  • Thanks for your help - will ignore and see what happens

So Indigo said " you must give us the driver's name and address", and you believed them.

    Amazing.
