This shocked and got me into panic mode. I have every aqua letters and once i found out, i made the guy wait on the phone until i open them all and not one letter mentions closure of my account. The only letter was a warning that my account will be sold to a debt collector agency.......
    (emphasis added)

So you didn't read any of the letters you had received and stuck them unopened in the back of the sofa (or wherever)?

Which means the warning that the sale of your debts, i.e. the closure of you account, as far as Aqua is concerned, was imminent didn't reach you until it was too late.

Is Aqua too responsible for you not opening the correspondence?

You don't like this but closing your account was clearly the prudent thing for them to do. And no better time than when they get paid. To keep you from doing exactly what you planned to. If I was them I would have done the same thing. And truth be told... You probably would have too, in their shoes.

I cannot believe this thread, you owed the money, you didn't make any payments for 6 mths, you ignored/unopened their letters, and you feel hard done by because they kept their money and probably did you a favour closing the account and prevented you getting in anymore debt.

I don't normally take the side of financial institutions but for the life of me i cannot see what they have done wrong.
  • I think the problem is that given you had fallen into arrears, you feel that by then making a payment, they "owed" you in the sense of continuing to provide you credit. As you say, had you known what would happen, you wouldn't have made the payment.

Unfortunately, such a "bargain" was not something they entered into and certainly not freely entered into. You had broken the T+Cs and were late. They wanted their money and you weren't giving it to them. So, once you did make the payment then of course they took it and feel they owe you nothing more. Their experience of you means they think it is too high risk to lend it back to you.

It does seem from what you say that there was some confusion/misinformation on the phone. You also may feel hard done by because you were sick. But on the other hand, that wasn't their fault either. People who have been unable to pay through sickness are probably more likely to have problems in the future with sickness again. Whatever the reality of your condition, they made a decision based on risk.
  • Let me get this right.

You owed them money. You paid them money. You want it back?

If you wanted to spend the money, why did you not simply use your debit card? Why did you pay off the balance instead of spending it yourself?

If you are 5 month's down, it's highly likely they would close your account down.

You chose to pay the balance off instead of spend it. There is little that can done now.
