Mediation - binding or not

Friend of mine got a claim form etc for £600+ and panicked.


Went to mediation and agreed to pay £250 on a monthly scheme.


Never actually signed the mediation agreement.


Told me about it yesterday and obviously I was gutted...would have been an easy defend...but hey ho!!


The crux of matter is ....Is the mediation agreement binding or not??


I know that of it is binding them he's pretty much stuffed.... as if he stops paying they can sue him for the mediation agreed amount and are pretty much guaranteed a win.

    So What If A Deal Is Reached?


    If terms of settlement are reached, the mediator will help record them and notify the court staff. The mediator will not however take any steps or be involved in enforcing the terms of a settlement if one party fails to comply (for example if someone agreed to pay a certain sum of money and failed to do so).


    Anything said during a mediation cannot be repeated to the Judge at trial, if terms of settlement are not reached. What is said is privileged and confidential. This is to ensure that the parties can feel able to speak freely to encourage help them narrow the issues and to reach terms of settlement.


    possibly time out the court claim , as the PPC will not have paid the court fees in time?

    Mediation or a real judge, that is the courts decision.

    Proves without any doubt that it is very foolish
    to accept mediation and these people don't have
    a clue and are on par with the CAB

    Anything agreed between the parties in a HMCTS telephone session is binding on both parties. It doesn't matter whether or not he signed anything, the call and outcome are recorded.

    It means that a stay is put on the claim, and if he fails to pay, they can apply to lift the stay and enforce Judgment.
