Debt with the ex

Hi. My partner is in £20,000 debt with his ex. They had a loan taken out in her name which he pays a direct debit into her bank each month. She is now saying she wants the whole amount paid off or him go back to her. Weve searched loans up to that amount to pay it all off but he hasnt got a home to secure it against. He is a tenant in a private letting. Full time job. Working 40 hours or more. Please can you offer any advice in how to clear this debt off with her...any loans he might be eligible for etc. Hes seriously depressed and worried over this. We need to sort it asap.

    ex-wife or ex-partner?
    If the loan is in her name, is there documentation that shows he has liability to pay it?

    So payment for romance, in effect. This tells you everything you need to know...

    If it is in her name, just ignore her.

    If it is in her name he has no legal obligation to pay her anything!

    How long would he need to stay with her until the debt is considered cleared?

    If he could agree a day rate of say £1k, that's not so bad. He'd be home within a month.

    He doesn't have to pay anything...Zero it's her debt. (Unless it's part of some divorce settlement)

    Why all of a sudden does she want this loan repaid? What's caused the urgency if he's been keeping up with his half of repayments?

    If your partner and his ex spent the £20k together and both agreed to repay it back jointly, regardless of the debt being taken out in her name, it would be a pretty sh!tty thing for your partner to not uphold that agreement just because they are no longer together.

    If he wants a clean break, there are plenty of lenders who will lend £10k - then he can pay the ex off and you can all move on with your lives.

    If he cannot get a loan for the full £10k for whatever reason, see if he would be eligible for a 0% money transfer card, depending on his salary, lots of people get large limits well above £10k.

    If he can't get a loan, can't get a money transfer card and has no savings, then he should continue paying the ex with the standing order (I presume he has this set up to go into her account every month) and leave it at that. You can't get blood out of a stone and if she kicks up fuss, then block her from all forms of communication. As long as she is getting back her monthly repayment from him, then she really has no grounds for complaint.

  • Thankyou for all your replies. I know there is no legal obligation but he wouldnt just leave her without paying it and i wouldnt want him to do that.
    It was just an ex Partner. Not wife. She wants the payment because of me. Because he has moved on. I suspect. But he wants to pay her off so he can move forward.
    We will definately look into the creditcard deals. And see what he can get.

    Surely he should only be liable (morally only, as it's not legal because it's in her name) to pay half, so 10,000?

  • The fact that he is making a monthly repayment when the debt is in her name suggests he has some decency. Perhaps he should inform the ex he will not be repaying her debt in full but will continue to pay monthly, however with an inference that these repayments are being made on a goodwill basis as long as she doesn't interfere in your relationship.
