Notice to landlord.. need help

hey..
My contract is due to expire 9th jan 08.. i have lined up a new place to live and due to move in next month some time (waiting on references)
Im not sure if i need to give 1 or 2 months notice to my current LL, i have read through the contract and it says nothing about how much notice i should give.. i have an assured short hold tennancy.
Also.. im not sure how to set out the notice letter.. sounds a bit stupid, but im rubbish at putting things in to word on paper...
Could you lovely people please help???

If your contract expires on 9 Jan 08 and the contract doesn't mention a breakclause then I'm afraid you are tied in until that date. I hope you haven't paid anything out on the new place...

really you need to pay up to the end of your contract, in this case until the 9th january. While the LL does have to mitigate his losses should you move out, he can insist on you paying up to the 9th jan.

Give your landlord as much notice as you can, be willing to have prospective tenants view, keep the place immaculate and hopefully he will be able to re-let it quickly and let you terminate your tenancy early.
As others have said, in the worst case you will have to pay rent until the end of your tenancy.0 -

If the agreement doesn't contain a break clause and the tenant wishes to surrender the tenancy during the fixed term of the agreement, normally a landlord would not wish to agree to it . However, under the law there should be some mechanism to allow the tenant to be released from their obligations before the end of the tenancy agreement so long as the landlords rights are not affected, and unless the landlord provides one the tenant may be entitled to assign the tenancy to another tenant. The landlord would not want this so it would be best to permit the tenant to end the tenancy early.
As a landlord myself, if the tenant has been decent throughout the tenancy (not caused to many problems) I would allow the tenant to move on without any penalty. Speak with the landlord, keep it informal intially.:beer:

When I was in this situation I rang my landlady initially and we made a verbal agreement. I followed this up in writing along the following lines.
Dear Mrs Landlady
As discussed, I have bought a house which I intend to move into on xxxxxx . I would therefore like to end my tenancy as soon as possible after that date.
We have agreed that I will pay rent until either a new tenancy starts or contracts for sale of the flat are exchanged. At that time, I will expect the return of my deposit of £xxxx.

As it turned out, the flat was still unsold at the end of my AST so I don't know if my letter would have stood up had the flat been sold or re-let earlier and the landlady tried to charge me rent up to the end of the AST.0 -
Just tell your Landlord now that you are giving notice that you will be vacating the property on or before the 9th January.
I wouldn't start trying to get a new tennant in quicker until your purchase has gone through and you have the keys... still plenty of things that could go wrong and you don't want to be left with no-where to live for a couple of months.Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0
