I have just received a decision that popla are refusing my mitigating circumstances and have to pay euro car parks. I’m currently in a long running DMP with very little spare income. Will ECP and or Debt recovery companies look into this before deciding whether to take me to court. Or will they simply take me to court?

Losing a popla appeal doesn't mean you " have" to pay.

Of course POPLA can't consider mitigation, their FAQS told you that before you started!
You should have come here when you got the PCN, we win v ECP at POPLA. Have a look in 'POPLA Decisions' and you will see recent posts where people won. Easy if you'd known how.

Pity you didn't come here first you would know all about POPLA, and the PPC scammers and their debt recovery muppets.

Many Thanks to every body for your advice. Here is what I put as mitigating circumstances. Reason For Appeal: I am a taxi driver registered to South Tyneside. On the day of the parking charge notice I was taking a mother to collect her disabled child from the game shop in the Denmark centre South Shields. The lady asked that I get as close as possible to the shop due to her child's disabilities. As Fowler street, South Shields is a no car zone and Albermarle street, South Shields is under construction the closest pick up point was the car park in Saville street. When I arrived the lady asked me to wait with my meter running whilst she collected her child. At this point I was not aware that it would be so long. I was unable to leave my vehicle running to purchase a ticket and if I were to turn off my ignition and lock my vehicle my meter would stop and I would not be able to carry out my fare.
I hope that you will take into consideration my mitigating circumstances and cancel this parking charge notice. I have attached my south Tyneside license for you records.

That's the most doomed appeal v a private parking firm we've seen in years. That is absolutely not what to write - a classic warning to others to read the NEWBIES thread before appealing.
You are a taxi diver, you will get more & so with your colleagues.
Next time come here FIRST, tell them that we win 99% of POPLA appeals & defences here and not to appeal about the story of what happened, as if PPCs are like Local Authorities!
Luckily, you have already been told by us, that ECP don't do court and they would be downright stupid for their first court case in 2018, to suddenly pick you, and drag a Taxi Driver with a disabled fare, in front of a Judge!
