When does a warranty begin?

Hello everyone,
23 months ago we had a repair done to the heater in our tourer caravan, the heater has failed again. Assuming it is the same fault we asked the question would the 2yr warranty cover it, we were told that the actual part (a motor) was bought some 6 months previous to it being fitted to our caravan..we didn't know this at the time... therefore the warranty had already elapsed.
Does the warranty with us start at the point it was fitted or the point at which the the part was bought by the caravan repairers?

  • As a warranty is not a legal right, it can begin whenever the business offering that warranty wants it to begin.

    I'm going to assume the warranty you mention is one offered by the repairer.

    If the repairer had offered a two year warranty on the repair and you are still within that timeframe, then the repairer should honour his warranty.
    The date the repairer bought the motor is irrelevant.

    Alternatively, you could consider your statutory rights.

    Under The Consumer Rights Act 2015 you have up to six years to seek a remedy from the seller - the repairer.
    The remedy could be a repair, replacement or refund.
    Keep in mind that the seller can reduce any refund to take account of the 23 months use you have had, and you may be asked to prove that the problem is due to an inherent fault.

    The seller may or may not be separate to the "repairer", as you put it.

    Since the OP doesn't state if the repair was made by the retailer (the word you perhaps were looking for) or the manufacturer (the other word you sought) we cannot be sure who is liable (if anyone for a repair).

    As for legislation, the op had a repair done 23 months ago, February 2016. Although not entirely clear the OP suggests the part repaired was purchased some 6 months prior to this repair - circa September 2015 - or even prior to that (and by someone else?), it's not clear from the
    post. But if it is Sept 2015 then it is not CRA.

    OP, a warranty is specifically at the terms and conditions it offers, by the person/company offering it. Your consumer rights depend on other things, not least when you purchased and from whom....

    Do we know the repair was purchased? No, therefore the seller isn't necessarily the repairer.

    You seem to have completely missed the point.

    The original purchase date by the OP is the date that matters. It will determine what legislation the OP has. In either case, the legislation he/she has is with the seller.

    Back to the OP. Your warranty is completely bound by the terms given by it. If the giver of the warranty says the start date is x then that is the start date. Your warranty rights and your consumer rights are separate.

    For the sake of clarity.... the question of warranty of the initial repair was raised by the receptionist at the repairer...she said the warranty was 12 months so had run out so we would have to pay...we wouldn't usually have questioned this but her high and mighty attitude made us a little testy...so we rang the supplier of the motor who told us the warranty was in fact for 2 years, when we raised this with "Mrs high and mighty" she said yes the warranty was 2 years on that part but that because they had bought the motor as a stock item some 6 months before actually fitting it as part of our repair that the 2 years had elapsed, the fact that we have only had it 23 months is irrelevant according to her.
    If Currys have TVs in stock for 6months before selling them would the same logic apply or would the warranty be at the point of sale to the customer?

    Which comes back to what I stated in the first reply to your question.

    If the business supplying the warranty states that it begins when the goods come into the possession of the retailer then that is exactly when it would begin.
    Having a warranty supplied when you make a purchase is not a legal right and because of this, the warranty supplier can state when it begins, when it expires and what is required in order to claim on that warranty.
