HELP!! court claim form from Excell Parking

Hello,

received a parking ticket probably over a year ago now for my car being done by one of the Excell car parks for staying 15 mins over the allowable time (12 hours and 15 minutes). there were a ticket that had been bought that day but by getting delayed by a train, the time limit went over.

They have sent many threatening letters but after reading things online I decided to ignore the letters. Now they have sent me a claim form from the county court bulk centre stating that I owe 185 pounds. It says if I do not do anything, judgement may be entered against you.

Can anyone give me any advice on what to do from here please as I am new to this stuff and only young.

    Is it filed by BW Legal? We beat them all the time.

    Read other Excel BW Legal cases, search the forum for those words and read defences. You could almost copy one and still win v Excel!

    We assume you've already read 'NEWBIES PLEASE READ THESE FAQS FIRST' and done the AOS online (shown in pctures in the second post of that sticky thread at the top of this forum).

    If not, go there now, first, learn what AOS is, get that done. Then see the example defences.

    Throughout here you are advised never to reveal who was driving


    You need to edit your OP to remove details of who was driving


    The ppcs monitor here and can use your posts against you


    if you inadvertently used your real name as your forum then get MSE to change it to something truly anonymous
  • Who does it say filed it. Usually this is a solicitor

    Newbies thread, page 2, read it, slowly. First item there will be to acknowledge the claim.
  • it doesnt mention anywhere who filed the claim... it only says claimant - Excel parking services. Do i find a template similar to my situation and write it online as i can do it on moneyclaim.co.uk

    I have read the newbies forum but still unsure what to do, can i not just leave it?

    if you leave it you will get a default CCJ in your name within 6 weeks

    there are no "templates" for this, you need to do the AOS online and then draft a defence to be filed , preferably within 28 days of the date of service

    its a live court claim from EXCEL themselves using the governments business centre for bulk claims located in Northampton (MCOL)

    google MCOL and then start drafting your defence, once you have signed in online and completed the AOS (do not put anything in the defence box)

    read the LAMILAD threads where he beat EXCEL in court more than once, plus any other EXCEL court case threads on here and on pepipoo forums over the last 18 months or so

    if you leave it, you will get a CCJ which will trash your credit rating for 6 years !!

    if you are not in england or wales , you would contest the MCOL because it only applies in E+W , so not if you live in Timbuctoo

    and also read a lot more of post #2 of that NEWBIES thread , especially read some of the links

    you have a live court case, so gen up on it, asap
