I am owed 40k from someone who lives in Eire. He asked for money over a period of 2yrs. I used my credit cards. I now am subject to an IVA, almost lost my house & credit rating is zero. 25% of my wages goes to IVA. I am so so worried about my money situation. One credit card company only agreed to the IVA, as when a relative of mine passes away, I will inherit a house which can be sold. They also want a extra 7% on top of the original debt.
How do I claim the money from the person who owes me as he lives in Eire? He has acknowledged the debt & has said he will pay monthly. I have all information in writing (text & emails). He has NOT paid one penny. Police & Action Fraud aren't interested as I gave the money voluntarily and we were in a relationship. He asked for the money right from the beginning of the relationship. I know I was an idiot. The relationship ended as he cheated. He promised me thousands of euros when a relative's house was sold.
I may appear calm, but inside I am screaming. My boiler hasn't been serviced for 2yrs. I worry about my car breaking down. I have so much on my plate, I feel I can't cope much more. Please help me.

Probably best to start your own thread but on the face if it - 2 outcomes;
He has not paid you anything and probably will not pay you anything so you will have to come to terms and move on.
If you want to take him to court you will have to pay for the leagl costs yourself, this costs will run into thousands but for your own sanity you have speak to a solicitor for half any hour for free, they should be able to lay out your options and possible costs - your only real hope is if he has propetry in his name and you can get a charging order so if he sells you get paid - but that is a long and expensive road.0 -

The simple answer is - there is nothing you can do. I really think you need to let that sink in and digest it and mull it over. Cry if you need to, but you are going to have to let it go if you want to move on with your life.
The suggestion of legal action may be mentioned by others, however he is in another country so unless you have ££££ to pay for a specialist solicitor familiar in European Law and all the other costs that that will entail with no guarantee of seeing a penny back, best of luck to you! By the sounds of it you are broke as it is so that's why I didn't mention it.
Try and be positive and think that although it was an expensive lesson, rather it be £40k loss than £400k. At the end of the day it is only money. You still have your house, a job, a car. If the debt is 40k, I would not let it go as this is an amount worth going after, even across the border.
You will not be able to get a payment order unless he wants for you to have it (the fact that you have proof doesn't matter, if he contests it, it won't be granted) so you will need professional help. The good thing is that it may cost you nothing, as there are many debt collection agencies operating in Ireland who collect on no success == no fee basis. Then the only fees apply are for court proceeding/enforcement if it comes to them, and those will be agreed with you ahead of time. But the upside is that most people when faced with professional debt collectors pay up, one way or another. You may have to settle for as little as 10k in the end, but that's better than nothing.0 -
The £40k question here is whether he actually has the assets or income to be worth going after!
If he has a house in Ireland with equity, a flashy motor, or a good job then it may well be worth doing down the legal route, getting judgement, then using debt collectors as per previous posters suggestion.
If on the other hand he has nothing and is just a waster, then it would merely be a pyhrric victory and more money down the drain.0 -
