G24 Salford Precinct.

Hi folks,

just checking I'm on the right track. Colleague parked up at Salford Shopping Centre, Pendleton Way, Salford.

Arrived at 14:xx and departed at 18:yy

Motorist bought "top" up ticket 3 minutes after 14:xx in order that she can stay an extra hour. Something motorist, and other colleagues have done a regular basis.

Now received letter from G24 stating permitted free parking is 180 minutes, your parking period is 224 minutes.

She has a copy of the top up ticket.



My advice to her is to appeal to the landowner and also send this, as kindly posted by CM.

Then the usual stuff before the "letter before court action."

Re PCN number:

I am the keeper of the vehicle which received this purported 'parking charge'. There will be no admissions as to who was driving and no assumptions can be drawn. I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable.

Should you fail to cancel this PCN immediately, I require the following information with your template rejection:

1. Does your charge represent damages for breach of contract? Answer yes or no.
2. Please provide dated photos of the signs that you say were on site, which you contend formed a contract.
3. Please provide all photographs taken of this vehicle.

I am alarmed by your contact and I do not give you consent to process any data relating to me, or this vehicle. I deny liability and will not respond to debt collectors. You must consider this letter a Section 10 Notice under the DPA, and should you fail to respond accordingly, your company will be reported to the Information Commissioner.

I have kept proof of submission of this appeal and will also be making a formal complaint to your client landowner.

If you are a current BPA member, send me a POPLA code. If you are an IPC firm, cease and desist with all contact.

    I attach a copy of the top-up ticket, and the first parking ticket, that the driver obtained that day, both of which cover the full stay. We assume your system is broken, rather like the entire industry, and we hope you enjoyed seeing the IPC Hurley/Davies 'conflict of interest' named and shamed in Parliament earlier this month where they unanimously condemned your entire 'outrageous scam' (Hansard).

    Further demands about this matter will be prima facie evidence of harassment.

    Do not contact me again about this matter unless to confirm that the Parking Notice is cancelled and I will not be troubled again. I will note the content of any other communications and will keep evidence of your unwarranted harassment and will be complaining to my MP, but I do not guarantee a reply to you again.

    CM you are a star!

    I still shout loudly from the rooftops about how Parking Eye treated us at Fistral.

    I was never the sharpest legal knife in the box, but quite frankly, I don't think you had to be to beat Parking Eye.

    My MP used it for the basis of his speech in Parliament (and that seems to have escalated well!) and only last week, I was talking to George Galloway on talk radio about our case.

    I suspect it was the shouting from the rooftops that got them kicked out of Fistral. (Albeit SMART have replaced them.)

    I take daily pleasure in the fact.

    You have, no doubt, advised your colleague to complain to her MP.
    You never know how far you can go until you go too far.

    We work closely with our MP's on other issues. They generally respect our opinions.
