Moral grounds will get you nowhere.
Their claim is they had a contract to charge you that amount. So, do you havea contract with them? Given you dont, you need to show some form of damage has been caused to you.
No idea what you mean about breaching your rights of fair trial? Or CPR27 not applying? A judge can decide CPR27.14 applies, against yuo, if they believe so - thats YOUR risk at court.0 -

The PPC had signs up allegedly offering you a contract.
The story goes that by parking you accepted the terms of the contract.
How does that compare with your case?
Do you have a contract with the PPC allowing you to claim £1000s from then for breach of contract?
Are the terms of your contract with the PPC clear enough to enforce your claim for £1000s?0 -

1 Yes. PPC had signs and I accepted their contract.
2 I have duly paid to keep my end of contract
3 Despite this I was then accused of stealing (not paying for parking = same thing)
4 I have informed them that it's not true and that I have evidence that shows otherwise
5 They accused me of lying and still demanded payment
6 Upon appealing to "independent" body they decided not to act on this.
If you go to the shop, pay for your shopping and security at the end will stop you for stealing the stuff you paid for, then show them your bank statement with the amount going to the shop they will call police to report theft - similar scenario...
If you carry on doing nothing, nothing changes (or perhaps it does, in the other direction)
It's almost like people start defending Euro Car Parks... madness

There are no grounds for CPR27 as they would be breaching my human rights of fair trial.
This is not a trial, it is a money claim
If the case was won could open floodgates for other people in similar situations.

I understand the scepticism of the people on this forum, and you are taking on a risk. But if you are willing to do that, and have the determination to go through with it, I say do it.
It'll make for an interesting case and win or lose add to our knowledge of how to fight such companies. Just make sure you are fully aware of the risks you are exposing yourself to.0 -

It's a no to both questions, but let me counter with another. If I suffer in an accident and get whiplash (never did on both counts) do I have a contract with the other driver to pay me the compensation? No. However when any damage occurred intentional or otherwise you have the right to claim against the one who causes it, am I wrong?

I love this - how can theft be not criminal? I am referring to stealing £5 worth of parking vs stealing £5 worth of shopping.
Is theft of services just a civil offence? What about intellectual property? Should piracy be civil offence too then?0 -

You would not be suing under Contract Law but under Tort of Negligence. As for your other questions, you have come to the wrong man.
