Council cleaning bill after accident.

Hi can anyone give advice, my son had an accident on a little road last April. The police came out and left agreeing it was 50/50 the insurance paid on same grounds then he got sent a bill for road cleaning which was forward to insurance. Yesterday he got a final demand for full amount pay or legal action, checked with insurance they paid half and other insurance have to pay half. Spoke to council who say until they get all payment they will not cash insurance check and he has to pay as police report says its his fault. Spoke to police they said they sent a letter to council outlining who was involved and what happened but never said it was my sons fault as they never did full investigation. But council insist police report blames him and he has to pay but they will not be able let us see the report. What can we do please thanks

Thanks for the reply but they will not pay they say they have paid half and will not pay the rest. They say to tell council it has to come from other persons insurance but council say my son then has to pay0 -
Let them take legal action where you can prove your insurer paid what it should. I'm pretty sure they are bluffing0

You should still pass on any claims for money to your insurer, even if they have said that they don't intend to pay.
You should not attempt to negotiate with the council directly, as this may cause the insurance company to deny any responsibility after that point.
Read the policy document. Here is an example from a policy document: "You or any insured driver must immediately send to your insurer any writ, summons, letter, claim or other document, unanswered."If it sticks, force it.
If it breaks, well it wasn't working right anyway.0
