EPCplc from London to Germany

Options
Hi All,

I would really appreciate your help... my short story is the following:

I am currently working in the UK as a contractor and I am driving a German company car. Every Tuesday at 6am in the morning I am stopping at Earl's Court to pick up two of my colleagues (lift-shares) to be more cost efficient and environmentally friendly. I always stop front Coop/McDonnalds, which is a red route area only for loading with 20mins time max.

The streets are always empty, no traffic at all so I thought I can stop there for a minute till my colleagues get in the car. This was all working out fine till January 2018. Last week the German company who I work for started to receive letters from EPClpc with photos attached from a redroute camera at Erals Court. They already received and I already payed 2 fines… basically I will be receiving a fine for every week from the beginning of this year. That means 8*65 pounds out of my pocket.

Last year I was stopping there without an issue, so I am thinking this might be a new camera.

Should I pay them all?

  • or you are basically putting two fingers up at UK law , knowing you have foreign plates , and thinking you are immune?
  • Arent Red Routes ran by TFL? Whats a PPC doing issuing charges for it?

If its from TFL then yes, carry on paying the fines. If its from a private company, then appeal, because its not a fine but an invoice.

Earl's Court = TFL so is a FINE

however , do they have jurisdiction , can TFL collect from residents of Germany

probably not hence the INVOICES from EPCplc

perhaps you should tell your boss to write back naming you , or simply not pay them

Why would I ? As far as I am aware, I am not breaking any laws by driving my German company car in the UK. I never thought I am immune, I always payed all my fines. And yes I was stupid enough to stop for a minute once a week on an empty street without realizing the consequences.

you are in fact allowed to do that

however the phrase "when in Rome" comes to mind

would you be happy if I blocked the high street in your hometown ?

perhaps you should read the other 100s of threads on this forum (search) and / or google to understand "IF" they are legally empowered to send an INVOICE*

    * note the word INVOICE EPCplc have no legal authority in the UK to issue FINES

EPC plc are just debt collectors, but they will not transfer liability from the vehicle owner/keeper to the driver, so that is a non-starter.

You can try to speak to TfL and see if you can appeal direct, but I strongly suspect that they will say they have closed the matter as it has gone to debt collection....

You can also try to speak to EPC plc, but from my experience, they are not very helpful in trying to resolve problems.

In the UK, EPC plc have no legal right to issue any sort of court claim, all they can do is send letters. Lots and lots of letters. But never anything more than letters - some may have a lot of red ink on them, if that is the type of thing that scares or upsets you into paying.
