Question About G24 PCNs Received

Options
Hi Guys

I have spent some time reading the NEWBIE info and some related threads but I just need some clarification about my particular situation. Instead of posting the notices I'll just summarise:

I was away for 3 weeks and when I returned home last week I found two "Contractual Parking Charge Notice" and a "Final Notice" from G24. They both relate to parking in the same location which was B&M's car park in Wales.

The first PCN is dated 3/1/18 which refers to my vehicle being parked over the free 120 minutes allowed (parking period 145 minutes) on 29.12.17. The final notice is dated 30.1.18.

The second PCN is dated 30.1.18 which refers to my vehicle being parked over the free 120 minutes allowed (parking period 169 minutes) on 22.1.18.

Obviously, I don't know when they were posted through my door but they appear to have been issued within the required timeframe.

On the back side of the Final Notice it reads: "It is now too late to appeal the Parking Charge. If, however, you feel you have mitigating circumstances which prevented you from contesting the Parking Charge earlier please immediately make your representation in writing to G24.

I did go back to B&M last week with a bunch of receipts and spoke to the assistant manager. She couldn't find a receipt that matched the dates stated on the PCN and she also said there was nothing she could do because my car was in their car park too far over the 120 minutes. She said I/the driver would have to prove that I/they were in the store all that time! It then goes on to give the IAS website, etc. However, I've read on here that IAS is a kangaroo court and therefore a waste of time. Should I just ignore and wait to see if they send court papers or a letter before action?

With regard to the second PCN dated 30.1.18, I am still within the 28-day period to appeal. I saw the template letter to IPC members so would you advise me to send that or just wait it out?

I look forward to your advice.

Yes send it and meanwhile try B&M Head Office, and really RANT about this 'outrageous scam' (Hansard 2.2.18).

    GET ANGRY ABOUT THIS TREATMENT.

Have you watched the Parliamentary debate from 2 weeks ago unanimously condemning this?

Complain to your MP to make sure they are on board with their MP counterparts in condemning the industry and ensuring a Bill has teeth to stop the worse rip-off trash.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences.

Parking Eye, Smart and a smaller company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (who take hundreds of these cases to court, and nearly always lose), who have also been reported to the regulatory authority.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind most of these companies may well be put out of business by Christmas.

Deep, having read the article you posted I am considering adding this paragraph to my appeal:

You should be aware that the BPA investigated UKPC in September 2015 over!allegations employees had changed time stamps on photos in Lincolnshire, Staffordshire and Worcester and as a result were temporarily suspended from using DVLA!!!8217;s database. BPA boss, Patrick Troy, told the BBC "If there's a repeat of any kind of misbehaviour, that will almost certainly result in expulsion or further suspension." Therefore the onus will be on you to prove that the driver has not been a victim of this malpractice.

What are your thoughts on this? I just thought that it would give them something else to think about.

What are you hoping for by adding anything to the appeal template?
