Unreasonable Admin Charge for Late Ground Rent

  • seems there are dozens of disgruntled Simarc leaseholders. in my case i explicitly told Simarc to only send via email that they agreed to as i dont have a postbox and all letters generally end up on the floor. however Simarc carried on sending by post to my non existent postbox so i never saw the ground rent demand. finally they do a basic check and do find an address that gets to me. in the ground charge are 2 late admin fees. one for £130 and another for £180. I explain and show documents proving the error was Simarc and they simply ignore. they say pay up or we will make your life difficult and continue to add charges. when will companies like this cease to exist, simply old school racketeering. Simarc know the cost and time to take Simarc to court are too great for most people so everyone settles and pays up. surely this is more fraud? Has anyone ever stood up to Simarc and actually got these ridiculous fees removed. i read my lease and only charge they can make is interset for late payment. there is no clause for charges. i give up as it simply does not matter how legally right or morally right you are they simply know that going to the FTT against a company that will probably try and put all legal charges on your head is not worth it. Any advice? Surely Simarc have got it coming to them someday for being morally devoid?:(

    Unfortunately Simarc are one of many notorious companies whose aim is to extract as much money as they can from leaseholders. At the moment service charges and fees are on the whole uncapped and unregulated.
    You can go to FTT but often this can cost you more in the long run and you need to be sure you can back up your argument. Leasehold Law is extremely complex and not for the faint hearted.
    If you check out the National Leasehold Campaign Facebook group you will find support there and advice from others who have dealt with Simarc sharks.
