Openreach carries out work illegally.

Hi

I hope I’ve found the right section to post this in

I’m looking for some advice with a Openreach/Sky

I have purchased a new house. I called sky and informed them I was moving. Set up all the moving bits to keep my contract with them

An engineer came on the appointment date but said the work couldn’t be carried out there and then. It just needed a line fitting from behind the house.
Said he would come back the following day.
Two days later and he still hadn’t been.
I called sky back and cancelled the contract. (There had been a lot of issues and i’d been without the internet 2 months)

That got cancelled everything straight away and I set up with Virgin, who were amazing and so quick to get me set up.

3 days after the missed appointment from Openreach, they turned up while I was out at work. And installed a line, pinned wires up the side of my house and poked it through the back door.
I had not been a sky customer for 2 days at this point.

I opened a complaint with sky as my back gate was locked. Therefore this engineer somehow broke into my garden and carried out work without any permission. They said engineers often climb over fences with ladders if they are not unlocked and they have an appointment.

Sky have said it’s nothing to do with them. So I opened a complaint with Openreach on 03/01/2018
I was assured the engineer who did the work’s manager would call me within three working days.
It’s now been over 2 weeks since then I have still not heard anything.

I email/tweet on a daily basis and they assure me every time it has been escalated.

What kind of result can I expect to get from them if I am wanting to seek compensation for my time chasing this up. (It’s been 7 weeks of chasing up now)
Also for the illegally entering my garden and carrying out work they were not permitted to do while I was out.
I inform them every time they have left exposed wires on my wooden decking and it has rained and snowed since. I am worried about the wires just being out as it’s a fire hazard. But they never get back to me about coming and undoing the work.

Any advice would be so appreciated. I am at my end with this whole situation!!

You need to find whether and when Sky cancelled the line install with Openreach before you can go any further
  • Sky apparently cancelled it the day I phone up. But two days before that open reach had missed their appointment. When I called Sky they said Openreach often just turn up another day without permission and carry out whatever they didn’t do when they missed the appointment.
But at this point I had cancelled days before and had locked and secured back gate that had been left unlocked for them for appointment before they didn’t turn up

My advice would be to see a solicitor as you are seeking compensation .

You could send the ISP a LBA / letter before action .
As BT OR are not a public facing company .

"I am worried about the wires just being out as it’s a fire hazard".

What sort of wires are they, that can be a fire hazard?
  • I don’t know what the wires are. That’s the exact point of this post.
I didn’t agree to them doing any work, they just did it.
I don’t know what the wires are, or what will happen if they keep getting wet and are touching the wood etc. It’s part of my concerns.
Thanks for your helpful reply though

Well if it was installed by Openreach then they are very likely to be phone lines so post no risk at all and there is zero chance of them causing a fire or any issues.
It's pretty easy to tell the difference between different type of wires by search on google and looking at pictures.

You cancelled with sky, sky needed to cancel with Openreach. This clearly didn't happen.

You fight is with Sky. As for entering you garden illegally, please if you want compensation you better come up with something better than that.
