Yes, that can be in a standard CEL defence, if you didn't say who was driving.
But there will be no hearing so you would not have to ''go to court''.
However you are likely to get a claim, all you do is copy and adapt a similar CEL defence and read some others you find when you search this forum for:
CEL discontinued
or
CEL discontinuance
