Over 6 years? Never received letters?

Hiya,

I know I had PPI on my credit card as I remember crying in a corridor asking them to let me use it because I’d lost my job but they wouldn’t.

I used the resolver and had a reply, they said they wrote to me twice but I never received a letter from them. I received a cheque for the commission of £72. I spoke to someone on the phone regarding the letters I never received and she said I was missold PPI but it was now over the time because I hadn’t replied.

Where do I go from here please as I can’t really prove that I never received the letters!?

  • I think you should just enjoy your £72 Plevin refund because you will never be able to prove that you didn't receive the letters the Bank sent you. Certainly, the Ombudsman will be unlikely to rule in your favour unless you can show that you were living at another address when the letters were sent..

    The woman on the 'phone will not have "admitted" anything. Similarly, the letters you were sent would have been simply an invitation to complain and not an acceptance of liability.

    Basically, you are now time-barred and so no investigation of your complaint has even taken place.

    You may well have been mis-sold, but that's not the issue here..

    Were the letters sent to an address you were no longer living at? If not, you won't get very far with any FOS referral.

    If that was indeed the case, then she exceeded her authority by making such a statement. Your complaint is time-barred, so no one will have investigated whether your PPI was mis-sold. You'll therefore get nowhere claiming that the "woman on the 'phone" said you were mis-sold.

    I notice you still haven't stated whether the letters were correctly addressed to you?

    Yes the letters were addressed to me so I am unsure why they never made it to me.

    Mistakes like that also do not lead to any liability. i.e. you dont benefit from them.

    The general position is that if the address is correct and the template used meets the standards, then it is assumed you received it and is sufficent to trigger the time bar.
