how do I request SDP backdating?

Options
I started getting SDP recently but I've been legible for it for a year. How do I request I get the previous years worth?

I phoned 0800 055 6688 which I thought was the correct number but the guy just said it was the JSA number

    Check any of your notification letters, they will give you the correct phone number.
  • Do you reckon they will pay me back a year's worth of SDP? I have been entitled to it since Jan 2017 but only claimed for it a month or two ago.

    If you were entitled to it then yes. Why didn't you ask for it to be backdated when you claimed?

    I'd recommend sending a letter like the one below, this is what I've been using on a regular basis and have had backdates applied for 5/6 years where applicable.
    I wish to request backdating of my SDP to the start of my PIP/DLA/AA claim on the following grounds:
    As per The Social Security and Child Support (Decisions and Appeals) Regulations 1999, Reg 6(2)(e) states that;
    A decision under section 10 may be made on the Secretary of State's own initiative or on an application made for the purpose on the basis that the decision to be superseded is a decision where-
    (i)the claimant has been awarded entitlement to a relevant benefit; and
    (ii)subsequent to the first day of the period to which that entitlement relates, the claimant or a member of his family becomes entitled to another relevant benefit or an increase in the rate of another relevant benefit;

    Reg 7(7)(a) of the same regulations states
    A decision which is superseded in accordance with regulation 6(2)(e) shall be superseded from the date on which entitlement arises to the other relevant benefit referred to in regulation 6(2)(e)(ii) or to an increase in the rate of that other relevant benefit;

    Therefore, I request that my SDP backdate is awarded from the start of my relevant benefit start date DD/MM/YYYY as I have met all other criteria since this date.
    Yours Faithfully,

    The address on the top of the ESA letter, or ring DWP and they will give you the address to send it to.

    These are the criteria for receiving the SDP with your ESA:

    For clarification, your mum would have to be receiving mid/high rate DLA for you to be eligible.
