Sorry not trying to be rude, but wheres the confusion? I am referring to my dad's case, whose got the CCJ issued against him. And I am writing on his behalf.Hi MSE's,
I am hoping to get some advice on behalf of my dad and am not sure if this is the correct place to contact regarding his issue.
So my dad's been paying a monthly service charge by way of a standing order with Lloyds bank. This has been happening for a number of years since he purchased the property. Only in Aug 2016, someone went and changed the reference of the payment at the bank, so the council were claiming that they did not receive the payments between Aug 2016 and Dec 2016. However, the bank confirmed the money was still going to the council but payments were not being attributed to my account due to the payment reference being deleted. My dad does not recall going to the bank to make a change. As that bank account is only for rental property dealings - service charges, mortgage payments etc.

Sorry - I have read it again and changed the OP haha. I was writing whilst he was telling me the issue - my bad!
But its his accounts, his property, his CCJ. I have nothing to do with it other than offering to help, by way of asking MSE's0 -
So money will make the stress better? A mistake was made, the matter's been sorted out, presumably your father is not actually out of pocket? Just how much money will wipe out the stress? I believe there might be a way to have the CCJ taken off his record (Google it) so he'll be back to where he was and he won't have to suffer any more stress.
No money will make the situation right, but the other problem is that they were trying to buy another property as a family home, but were not able to due to this CCJ.
I guess it is a matter of principle - why is the council wasting tax payer money to issue a CCJ? They added £200 for court costs and could not even instruct their solicitors properly to send court/official paperwork to the correct address.
He went to a family friend who is a solicitor dealing with property etc, he advised that an agreement could be made between my father and the council, and solicitor can create a draft order to have CCJ removed because payment has been paid in full.
When father spoke to the council, they were not willing to help. The legal office in the council said to him she has no knowledge in how to remove the CCJ, and its a matter fr their solicitor. And that my dad has to spend money by going to court and remove it him self.
The CCJ will be satisfied - but it should not have been there in the first place.0 -
You would be better getting this moved to the Housing board (or possibly Cutting Tax) where the expertise on Council Tax tends to be found, particularly if you can get a response from CIS.0
